The James D Wertheimer Trust was created under a trust agreement dated August 4, 1933. In compliance with this trust agreement, KeyBank serving as trustee, following the death of Howard M. Wertheimer, (which occurred on 09/09/1984), pays net income to the Jewish Welfare Federation of Cleveland, Ohio as dictated per page (2) of the May 17, 1943 modification. The Jewish Welfare Federation is now known as the Jewish Community Federation. Under the Ohio Instituional Trust Funds Act of 1999, this beneficiary has chosen to receive the maximum of income based on the greater of 5% of AFV or traditional income. KeyBank maintains a responsiveness to the needs and activities of this beneficiary in the attainment of its mission.
